Right of withdrawal

The Buyer, who is the consumer, in accordance with the definition set by the Consumer Rights Protection Law, may use the right of withdrawal and refuse from the products purchased on the online store buvniecibas-abc.lv within fourteen (14) days, and return them back to the Seller.

The term for use of the right of withdrawal shall be counted as of the day, when the Buyer or the third person, who is not the carrier and who is specified by the Buyer as the recipient of the product, has acquired the product in possession.

The Buyer shall inform the Seller on the decision to withdraw from the Agreement prior to expiry of the term of withdrawal by using the sample of the standard withdrawal form HERE or by sending any clear notification to the Seller regarding the decision to withdraw from the Agreement. The Buyer may send the completed form or any other clear notification on withdrawal via e-mail: i-veikals@buvniecibas-abc.lv or to submit in outlets of the Seller.

Should the Buyer fail to use the sample of the standard withdrawal form, the Buyer shall specify in the notification regarding use of the right of withdrawal the information on the date of the order made, the date, when the product was acquired in the possession, name and surname of the Buyer and precise name of the product.

The Buyer shall return the product to the Seller within 14 (fourteen) days at the latest once he has sent a withdrawal form or notification regarding the use of the right of withdrawal to the Seller.

The Seller shall pay back to the Buyer the amount of money paid by him or her for the product within 14 (fourteen) days from the day, when he has received the notification of the Buyer regarding the notification on the decision to withdraw. The Seller shall pay back the above mentioned amount of money by using the same type of payment the Buyer has used, except for cases, when the Buyer and the Seller have agreed otherwise.

The Seller shall be entitled to suspend the repayment of the paid amount of money until the moment, when the Seller has received the product or the Buyer has submitted a certification to the Seller regarding the fact that the product has been sent back.

Should the Buyer clearly show an intention to use the type of delivery that is not the cheapest standard type of delivery offered by the Seller, the Seller shall not have an obligation to compensate additional delivery costs to the Buyer.

Direct expenses of the Buyer with regard to return of the product shall be covered by the Buyer.

The Buyer shall be responsible for maintenance of the quality and safety of the product during the whole period of implementation of the right of withdrawal. When using the right of withdrawal the Buyer shall be responsible for any decrease of the value of the product, should the product be used in a way that is not corresponding with the principle of good faith, including used for any other purpose rather than establishment of properties or operation of the product.

Within the period of implementation of the right of withdrawal, the Buyer shall be entitled to use the product to the extent it is necessary for examination of the nature, properties and operation of the product (to the same extent it could be performed prior to acquisition of the product in the outlet). Products shall be not damaged, not losing the initial appearance (without removed and damaged labels or removed protective films etc.) and not used. Should the product be not in full set or original packaging, or the package of the product be significantly damaged (except for the case, when it is not possible to open the packaging without damaging it), or the product be damaged, the Seller shall be entitled to reduce the value of the product in proportion to the depreciation of the product or not to accept the product. The proportional amount shall be calculated on the basis of the purchase price that the Buyer has paid for the product. The Seller shall inform the Buyer on reduction of the value of the product by sending a notification to the e-mail address specified in the order.

The Buyer shall return the product to the Seller in the original packaging thereof, in the same set like it was received, together with accompanying documents - a guarantee voucher (should any be issued), service instruction and other documents related to the product.

The Buyer may not use the right of withdrawal if:

• the price of the product or service depends from fluctuations in the financial market that the Seller cannot control and which may occur within the period of the right of withdrawal;
• the product is produced pursuant to the instructions of the Buyer or the product is clearly personalized;
• the product damages soon or the period of validity will expire soon;
• the Buyer has opened the packaging of the product, which may not be returned due to health and hygiene reasons;
• the product has been permanently mixed with other items due to properties thereof after delivery;

The Buyer has requested the Seller to appear and to perform urgent repair works or technical service works. Should the Seller, when arriving to the Buyer, deliver the products that are not the required spare parts in order to perform repair works or technical service works, the right of withdrawal are to be applied to the above mentioned auxiliary goods.

The right of withdrawal shall not refer to legal persons and to such persons, who are not a consumer within the meaning of the Consumer Rights Protection Law.
